All services are provided on an “as-is” and “as-available” basis.

3. No Guarantees

We do not guarantee revenue, conversions, lead quality, sales performance, or business outcomes. Results depend on factors outside our control, including market conditions and client execution.

4. Client Responsibilities & Legal Compliance

You represent and warrant that:

• You have the legal right to provide any contact information submitted
• You have obtained all required consent for contacts you upload or message
• You comply with all applicable laws, including TCPA, CAN-SPAM, and data protection regulations
• You are solely responsible for how you use our services and messaging tools

5. SMS & Messaging Terms

If you opt in to receive SMS messages from us, you agree to receive non-marketing and/or marketing messages based on the consent you provide.

• Message frequency may vary
• Message and data rates may apply
• You can opt out at any time by replying STOP
• You can request assistance by replying HELP

After opting out, you may receive a confirmation message. If you re-subscribe, messages will resume.

Carriers are not liable for delayed or undelivered messages.

6. Use of AI & Automation

Our services may utilize artificial intelligence, automated workflows, and third-party platforms. You acknowledge that AI-generated content may contain errors and should be reviewed before reliance.

7. Intellectual Property

All content, software, workflows, prompts, and materials are the intellectual property of Obsidian AI Technologies unless otherwise stated. Unauthorized use is prohibited.

8. Limitation of Liability

To the maximum extent permitted by law, Obsidian AI Technologies shall not be liable for indirect, incidental, consequential, or special damages, including lost profits, data loss, or business interruption.

Our total liability shall not exceed the amount paid to us in the thirty (30) days preceding the claim.

You agree to indemnify and hold harmless Obsidian AI Technologies from any claims arising from:

• Your misuse of the services
• Violation of applicable laws or regulations
• Unauthorized or unlawful messaging practices

10. Suspension & Termination

We reserve the right to suspend or terminate access to our services at any time, with or without notice, for violations of these Terms or applicable law.

11. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
